1. Operator
The service designated BusinessDash is operated by the company We make AI work s.r.o., identification number (IČO) 29697115, with its registered office at Nové sady 988/2, Staré Brno, 602 00 Brno, incorporated and registered in the Commercial Register maintained by the Regional Court in Brno under file number C 152497 (hereinafter the "Operator"). The designation "BusinessDash" constitutes a commercial designation of the Operator's product; any and all contractual relationships arising hereunder are concluded exclusively with We make AI work s.r.o. Contact for service of notices: support@businessdash.eu.
2. Scope of application
These Terms and Conditions (the "Terms") govern the legal relationship between the Operator and any person using the service BusinessDash accessible at businessdash.eu (the "User"). By establishing a user account, effecting a purchase, or otherwise using the service, the User expresses unconditional assent to these Terms.
3. Specification of the service — what BusinessDash is
The service designated BusinessDash constitutes the identity and organisation layer of the Operator's business software suite, whose modules are separate services each governed by its own terms, the first being AccountingDash (accountingdash.eu). Access is granted upon registration or by invitation; a natural person registering provides an electronic mail address and the name of an organisation, which is established, together with the module chosen on a trial basis, only upon use of a single-use link delivered to that address; a natural person completes a registration or accepts an invitation by registering a passkey (WebAuthn credential), no password being employed. A User holding an account may alternatively authenticate by means of the Google account bearing the User's verified electronic mail address, in which case Google learns of the authentication. The service establishes memberships of natural persons in organisations, each carrying a role (owner, administrator, member), and communicates to a module, upon the User's request, the User's identity, the organisation on whose behalf the User acts and the modules held by that organisation; authorisation within a module is determined by that module alone. Upon loss of all passkeys, access may be restored by means of a single-use link delivered to the User's electronic mail address. The BusinessDash account is provided free of charge; no chargeable product is offered at businessdash.eu, and the price, VAT status, duration and renewal of any chargeable module shall be communicated in that module's terms prior to payment. Each natural person shall hold one account; the owner of an organisation is responsible for the persons admitted thereto; a User acting for a company warrants authority so to act. A User may close the account on the account page, upon renewed authentication and express confirmation, or request its closure at support@businessdash.eu, whereupon the User is erased from the service and from every module; the last owner of an organisation having other members shall first transfer ownership. An owner of an organisation may, upon renewed authentication and express confirmation, request the deletion of the organisation, which shall take effect thirty (30) days after the request; until then any owner may revoke the request, the date being displayed to every member and the owners being reminded by electronic mail seven days and one day beforehand. Upon the deletion taking effect, access to the organisation ceases and every module deletes all data kept for it, including in AccountingDash the tax documents issued by the organisation, and the Operator retains no copy. The retention of the organisation's tax and accounting records for the period prescribed by law is the obligation of the organisation, which may obtain each module's data beforehand.
4. Remuneration and payment terms
Prices are communicated at the point of purchase in the currency displayed. Payment services are rendered by Mollie B.V.; the Operator does not store payment card data. The Operator is not registered for value added tax. Modifications of pricing shall in no case affect periods already paid for and shall be announced by way of an amendment to these Terms pursuant to Article 9.
5. Digital content; right of withdrawal
In respect of one-off digital content delivered forthwith upon purchase, the User, by completing the purchase, grants express consent to immediate performance and acknowledges that such consent entails the extinction of the right to withdraw from the contract within fourteen days, pursuant to Section 1837(l) of Act No. 89/2012 Coll., Civil Code, and Article 16(m) of Directive 2011/83/EU. Subscriptions may be terminated by the User at any time with effect as of the expiration of the period paid for.
6. Prohibited conduct
The User shall refrain from: dissemination of unlawful content; interference with the integrity, availability or security of the service; automated extraction of data; resale of the service; and circumvention of access or payment mechanisms. In the event of material breach, the Operator is entitled to suspend the User's account, having first issued a warning where practicable.
7. Liability
The Operator renders the service with due professional care. To the maximum extent permissible under applicable law, the Operator shall not be liable for indirect or consequential damage, nor for interruptions attributable to circumstances beyond its control; the aggregate liability of the Operator is limited to the sums paid by the User for the service in the twelve months preceding the event giving rise to the claim. Statutory liability which cannot be contractually limited, including under Section 2898 of the Civil Code, remains unaffected.
8. Protection of personal data
The processing of personal data is governed by the Privacy Policy published at https://businessdash.eu/privacy, which forms an integral informational annex hereto.
9. Amendments
The Operator reserves the right to amend these Terms in the event of changes to the service, its pricing, or applicable legislation. The version currently in force, including its number and effective date, is published at https://businessdash.eu/terms. Material amendments affecting a subsisting subscription shall be notified in advance; the User is entitled to terminate prior to their entry into effect.
10. Governing law and dispute resolution
These Terms are governed by the law of the Czech Republic. The courts of the Czech Republic have jurisdiction, without prejudice to mandatory consumer-protection provisions of the state of the User's habitual residence (Article 6 of Regulation (EC) No 593/2008). Consumers are entitled to out-of-court dispute resolution before the Czech Trade Inspection Authority (https://adr.coi.cz) or via the European ODR platform (https://ec.europa.eu/consumers/odr).
